THE DAVAO DE ORO LIBEL CASE: Fake radio broadcasters, fake radio station

In the libel cases filed by Governor Jayvee Tyron Uy and his father Provincial Board member Arturo “Chiongkee” Uy, the Davao de Oro government officials were not only facing up to radio broadcasters whodo not play the media profession by the rules.

The Uys were also up against an eight-man band of fake radio broadcasters brutally firing unfounded defamatory missiles from an unlicensed radio station, without regard whatsoever to even the barest requirement of media ethics.

The gang calls their group as the Magnificent 8, but critics gave them an obnoxious name, Otso Inidoro, to do justice to the garbage that spews out of their mouth.

Since early May this year the Uys endured a barrage of brutal commentaries fired early morning, noon and evening by the Otso Inidoro gang from two FM radio stations (InfiniteRadio FM 96.1-Tagum City and Power Radio 94.7 – DavaoCity) accusing them of corruption and other irregularities.

The black propaganda being fired just months before the May 2022 elections, the Uys can only suspect that the Otso Inidoro was hired by a Davao de Oro politician who wanted to challenge Gov Uy’s reelection and a Davao del Norte politician whose reelection could be challenged by an Uy.

Talks say the Davao de Oro politician coughed up half-a-million pesos to the Otso Inidoro to conduct the smear drive against the Uys.

Records also show that the Otso Inidoro gang are listed in the payroll of the Davao del Norte Office of the Govvernor receiving as much as P30,000 per month.

The Otso Inidoro gang members are also not accredited by the Kapisanan ng mga Brodkasters ng Pilipinas (KBP), the agency that police violations of media ethics in the broadcast industry.

Mainstream broadcast media players consider the Otso Inidoro gang as fake broadcasters and jestingly tag the group as members of the Kapisanan ng mga Pekeng Brodkasters ng Pilipinas (KPBP).

One of the two radio stations, Tagum City-based Infinite Radio 96.1, where Otso Inidoro broadcast its defmation against the Uys, is also not licensed, operating as a branch of another station with an expired franchise.

The Otso Inidoro gang vowed to send the Uys to jail for alleged overpricing in government purchases and other irregularities, but they may find themselves soon behind bars courtesy of their foul mouths.

The Uys have already filed against the Otso Inidoro more than a hundred counts of libel and cyber libel, based on two months of their morning, noon and evening scurrilous and defamatory assaults on the person and reputation of the Uys, in their radio commentaries and in social media.

The Uys’ legal counsel, Glen Carnicer, said the Uys have never filed a libel case against the media in their long years in government.

The Uys respect the role of media in government, said Carnicer in an interview in the Bakbak program hosted by anchorman Kid Libunao on Tagum City-based RPFM 99.9 radio on Monday, July 5.

PART I: Did the Governor order the Otso Inidoro attacks

Radio broadcasters working at the information office of the Davao del Norte Capitol under Governor Edwin Jubahib are facing multiple counts of libel and cyber libel cases for “deliberately maligning and defaming” Davao de Oro Governor Jayvee Tyron Uy and his father Provincial Board member Arturo “Chiongkee” Uy.

Lawyer Glen Carnicer, the legal counsel of the Uys, said 20 counts of libel and 20 counts of cyber libel or 40 counts against each member of the group have already been filed in court.

“We are still continuing to prepare more cases, said Carnicer in an interview in Tagum City-based radio station RPFM 99.9 on Monday, July 5.

Even as the broadcasters are employees of Capitol, Carnicer did not say if the broadcasters are under instruction by Jubahib to hit the Uys.

But he said the Uys suspect political motives as the attacks in the broadcast of the group are always followed with the group promoting their candidates. There is a deliberate purpose to malign and defame the Uy family with the malicious commentaries so there is political motive, said Carnicer in the Bakbak radio program , also streamlined on Facebook, anchored by Kid Libunao.

The group of eight broadcasters since early May had launched brutal attacks in their commentaries against the Uys, accusing the officials of various acts of corruption in government deals.

Documents from Capitol, have identified the members of the broadcasters working at theProvincial Information, Communication and Knowledge Management Office (PICKMO) under the Office of the Governor, their designation and compensation.

Uy is capping his last and final term in a 9-year governance that saw the province transform into one of the most progressive provinces in the Davao Region.
Tyrone has proven himself to be capable of continuing the momentum of development that Comvalenos and I and the local officialdom pushed during my administration, said Uy.
But Uy said the final choice on who will run for governor will be picked during a convention he would call to be attended by members of the Provincial Board, barangay captains and councilmen and political leaders.

NPA denies hand in ambush-slay of Compostela Valley mayor Rey Navarro

The New People’s Army (NPA) said it has nothing to do with the ambush-killing of Laak Mayor Rey Navarro of Compostela Valley province despite the mayor’s involvement in illegal logging.

Navarro’s track record did not make him a legitimate military target, thus, no revolutionary punishment was executed against him, “ said Rigoberto Sanchez, spokesman of the NPA Operations Command in Southern Mindanao, in a statement emailed to durianburgdavao today, May 29.

“The New People’s Army Southern Mindanao Regional Operations Command condemns the killing of Mayor Reynaldo Navarro and offers condolences with his family and colleagues,” said Sanchez.

Navarro was shot dead Wednesday morning in Asuncion town by motorcycle-riding gunmen. He was in the lead car of a two-vehicle convoy when waylaid around 8:30 AM. His security escorts engaged the gunmen in a firefight killing two of them.

Media reports had quoted Lt.Col. Lyndon Paniza, spokesman of the Army’s Eastern Mindanao Command based in Davao City, as blaming the NPA for the ambush of  Navarro, a former Compostela Valley vice governor and on his last term as Laak mayor.

In accusing the NPA of Navarro’s ambush, the 10th Infantry Division-Eastern Mindanao Command-AFP shows that it is poised to agitate and conscript Navarro’s Lumad supporters and followers, said Sanchez.

Sanchez said that as a politician. Navarro had “cooperated” with the NPA and “demonstrated actions that point to his recognition of the revolutionary cause.”

Navarro had been warned and cautioned against his involvement in illegal logging but he has no “grave offenses” that would warrant a Death penalty, said Sanchez.

Sanchez denial of NPA involvement in Navarro’s death came even as the mayor had earlier been tagged as a “legitimate target” by another NPA unit.

In a statement emailed to durianburgdavao on May 22, a week before he was killed, the NPA-Comval-North Davao South Agusan Sub-regional Command said Navarro is a member of the “Big 4 logging lords”  operating in Laak.

The statement was supported by video footage of cut logs strewn along  roads that, according to the NPA, proved “logging is rampant in Laak villages.”

“For as long as local reactionaries like Navarro continue to make big business out of the remaining forest resources, the NPA will impose measures to protect the environment and peasants, Lumads and masses who suffer from the effects of rampant logging. Fascist troops who continue to violate human rights of peasants while plundering the forests are legitimate targets, said Ka Aris Francisco, spokesperson of the NPA sub-regional command.click

Navarro’s track record did not make him a legitimate military target

The New People’s Army Southern Mindanao Regional Operations Command condemns the killing of Mayor Reynaldo Navarro and offers condolences with his family and colleagues in Laak, Compostela Valley.

While Navarro was part of the Big 4 in Agusan-Comval-Davao del Norte forests, the NPA has not considered him an enemy that warrants a standing order or a recipient of a death sentence. Navarro’s track record did not make him a legitimate military target, thus, no revolutionary punishment was executed against him. 

As a long-time politician whose area covers territories of the People’s Democratic Government in Compostela Valley, Navarro has cooperated with comrades and in many ways have demonstrated actions that point to his recognition of the revolutionary cause.

In the last few years, however, his business interest in logging and agribusiness expansion has increased. Comrades have repeatedly warned him of his increasing anti-people activities.

Navarro had merely ignored these warnings, thus, forcing the NPA Comval-North Davao South Agusan Sub-regional Command to caution him publicly against wanton logging, militarization and the attendant human rights abuses that occur during these operations.

In the midst of these warnings, there are no strong grounds showing Navarro’s grave offenses against the revolutionary movement that would necessitate the People’s Democratic Government to hand down the maximum penalty of capital punishment.

In accusing the NPA of Navarro’s ambush, the 10th Infantry Division-Eastern Mindanao Command-AFP shows that it is poised to agitate and conscript Navarro’s Lumad supporters and followers to become its new lackeys and bandits under the Oplan Bayanihan counterrevolutionary campaign.

The masses in Laak should see to this latest anti-people machination and must struggle against fascism.

        The bid of Congressman Rommel ‘Bobong’ Amatong to become governor of Compostela Valley in 2016 has crashed, suffering premature death after the First District representative surfaced as among legislators reported to have impregnated  their pockets  with fat kickbacks for ghost projects from scam queen Janet Lim Napoles.

        Napoles is at the core of the P10 Billion Priority Development Assistance Fund (PDAF) racket, where members of Congress are alleged to have received commissions from ghost projects awarded to bogus non-government organizations (NGOs) of Napoles.

        The fatal blow dealt on the political future of Amatong, who is winding up his three consecutive terms, comes ahead of the 2016 elections where he plans to run for governor.

terms and his Uswag ComVal bloc have picked Provincial Board member and former vice governor Ramil Gentugaya to fill in his shoes.

        With his link to the PDAF scam, karma could be overtaking Amatong, who also belongs to Uswag ComVal but has reportedly aligned himself with the opposition to run for governor against Gentugaya.   

        Accordingly, Amatong was expected to be expelled from Uswag ComVal if he pushes his plan to run against Gentugaya in 2016.

Several lists of congressmen alleged by Napoles to have received the kickbacks have surfaced as the Department of Justice, the Ombudsman, the Commission on Audit and Senate blue ribbon committee continue their probe into the biggest scandal in Philippine political history.

        The name of Amatong was persistently present in the lists as reported by media,  among them from former Senator Panfilo Lacson that he submitted to the Senate blue ribbon and another from the Department of Justice submitted by Napoles to Sec. Leila de Lima.
